TERMS OF SERVICE

VIETALITY – Healthy the Vietnamese Way

1. Introduction

These Terms of Service ("Terms") govern the rights and obligations of Users when using the VIETALITY – Healthy the Vietnamese Way mobile application ("Application").

The Application is provided and operated by:

Vincent Holdings Co., Ltd. ("Company", "We", "Us", or "Our")

By downloading, registering an account, or using the Application, the User confirms that they have read, understood, and agreed to comply with these Terms. If the User does not agree to these Terms, please discontinue use of the Application.

2. Definitions

For the purposes of this document, the following terms shall have the meanings set out below:

  • "Body Metrics Data" means information provided by the User, including height, weight, age, and gender, for the purpose of calculating estimated indicators (e.g., BMI, TDEE).
  • "Nutrition Data" means information regarding meals, foods, and beverages entered by the User to calculate calories and nutritional values.
  • "Physical Activity Data" means information relating to activity frequency, exercises, steps, workout types, and duration recorded or synchronized by the User.
  • "Estimated Indicators" means results calculated by the Application based on User data (e.g., BMI, TDEE, recommended calorie intake) and are provided for reference purposes only.

3. Scope of Services

The Application provides tools to support Users in:

  • Tracking body metrics and nutrition data
  • Recording physical activity data
  • Receiving information and suggestions related to a healthy lifestyle

The Application is designed to assist Users in managing personal nutrition and physical activity information and does not replace professional medical services.

4. Conditions of Use

The User represents and warrants that:

  • The User is at least 18 years old and has full civil capacity under Vietnamese law.
  • If under 18 years old, use of the Application must be under lawful guardian supervision.
  • The information provided by the User is accurate and truthful.
  • The User is responsible for safeguarding account login information.

The User must not:

  • Use the Application for any purpose contrary to Vietnamese law.
  • Infringe upon privacy rights, personal data protection rights, or other lawful rights and interests of organizations or individuals.
  • Intentionally gain unauthorized access or disrupt system operations.
  • Distribute malware or unlawful content.

5. User Accounts

To use certain features, Users must create an account using an email address. The User is responsible for:

  • Maintaining the confidentiality of account information.
  • All activities occurring under their account.
  • Promptly notifying the Company upon discovering any unauthorized access.

We reserve the right to suspend or terminate accounts if violations of these Terms are detected.

6. Accuracy of Information

We strive to provide information in good faith and in alignment with the purpose of supporting Users in tracking physical activity and nutrition. However, Users understand and agree that:

Individual body metrics, physical activity, and nutrition data are influenced by many objective and personal factors. Any results, analyses, or suggestions provided by the Application are for reference and support purposes only and do not replace professional medical advice, diagnosis, or treatment.

Users are solely responsible for their use of information from the Application, including evaluating its suitability and consulting healthcare professionals where necessary, in accordance with applicable laws.

7. Intellectual Property

All content, design, software, logos, and features of the Application are owned by the Company or its licensors. Users may not:

  • Copy
  • Modify
  • Distribute
  • Reverse engineer or exploit source code

8. Limitation of Liability

To the extent permitted by law, the Company shall not be liable for:

  • Damages arising from the use or inability to use the Application.
  • Data inaccuracies resulting from User input.
  • Data loss due to device or software errors.
  • Service interruptions beyond our control.

The Application is provided on an "as is" and "as available" basis.

9. Termination

Users may discontinue use of the Application at any time. The Company reserves the right to terminate or restrict access if:

  • The User violates these Terms.
  • The User engages in conduct posing risks to the system or other users.
  • Required by competent authorities.

10. Third-Party Services

The Application may contain links to or integrations with third-party services. Unless otherwise required by law, we are not responsible for:

  • The content, information, policies, terms of use, or data protection practices of third parties.
  • The operations or services of third parties that are beyond our control.

Users assume full responsibility when using third-party services.

11. Updates and Changes

We may:

  • Update features.
  • Modify or discontinue services.
  • Update these Terms.

Where material changes occur, we will notify Users within the Application. Continued use of the Application following updates constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Vietnam. Any disputes arising shall be resolved in accordance with applicable Vietnamese law.
